A registered trademark in India is valid for 10 years from date of filing. After 10 years, you must renew it to maintain exclusive rights. If not renewed, your trademark can be removed from the register.

Renewal can be done 6 months before expiry (timely) or within 6 months after expiry (late, with surcharge). After 6 months post-expiry, the trademark is permanently removed.

Renewal FAQs

Renew from 6 months before expiry. The expiry date is exactly 10 years from original filing date. We recommend renewing 3–6 months before expiry to avoid complications.
You have a 6-month grace period with 50% surcharge. After this, the trademark is cancelled. You'd need to file a fresh application, losing your original filing date priority.
Apply for restoration within 1 year of cancellation under Section 25(4). Restoration fee + renewal fee applies. After 1 year, you must file a fresh application.
